Terms, use, and responsibilities

Welcome to MOK INSURANCE. Below, we present the terms and conditions that govern the use of our services and the contracting of insurance policies through our website and physical offices in the state of Texas, United States.

Acceptance of the terms and conditions

By using the services of MOK INSURANCE, whether through our website, by telephone or in person, the client agrees to comply with and be bound by the terms and conditions described herein. If you do not agree with these terms, we ask that you do not use our services.

Use of the website and services

  • Registration and user account: To use certain MOK INSURANCE services, it may be necessary to create a user account. It is the client's responsibility to provide accurate information and maintain the confidentiality of their login credentials.

  • Proper use: You must use our services only for legal purposes and in accordance with these terms and applicable laws.

Insurance products and services

  • Quotes and policy application: Insurance quotes provided by MOK INSURANCE are subject to availability and approval by participating insurance companies. Requesting a quote does not guarantee the issuance of a policy.

  • Verification of information: We reserve the right to verify information provided by the client to assess risk and determine eligibility for insurance coverage.

Client Responsibilities

  • Truthful information: When requesting a quote or taking out an insurance policy, the client guarantees that all information provided is true, accurate and complete.

  • Use of personal data: The client understands and accepts the processing of their personal data in accordance with our privacy policy.

Payments and billing

  • Payment methods: MOK INSURANCE offers various payment options, including online, in-office, and telephone payment. Details of the payment methods are specified in our relevant section.

  • Auto pay: Customer may choose to enroll in auto pay service to avoid interruption of their coverage due to non-payment. Enrollment is subject to approval and availability by insurance companies.

Cancellation of policies

  • Procedures: The client has the right to request the cancellation of their policy at any time. The cancellation process must follow the procedures established by the corresponding insurance company.

  • Cancellation charges: Cancellation may be subject to specific charges and conditions, detailed in the policy terms and conditions.

Liability and Limitation of Liability

  • Exclusion of guarantees: MOK INSURANCE makes no express or implied warranties about the availability, accuracy, reliability or suitability of the insurance products offered by the insurance companies for any particular purpose. This means that MOK INSURANCE does not in any way warrant or promise that the insurance products offered by the insurance companies are error-free, accurate at all times, available at all times or suitable for any specific purpose the customer may have in mind. This is important because, although MOK INSURANCE strives to offer quality and reliable insurance products, the nature of the insurance industry and external factors such as changes in government regulations or market conditions may affect the availability and accuracy of the information and services provided.

  • Limitation of liability: To the maximum extent permitted by law, MOK INSURANCE shall not be liable for any direct, indirect, incidental, consequential or special damages arising from the use of the insurance products offered by the insurance company. Damages may include loss of profits, loss of data, business interruption or other similar types of damages. This means that, although MOK INSURANCE strives to offer reliable insurance products, there are situations beyond its control that could negatively affect the customer, and MOK INSURANCE will not accept liability for these damages.

Electronic Communications and Coverage Binding

  • Electronic Communications: By communicating with MOK INSURANCE via email, web forms, text messages, or other electronic means, you acknowledge that such communications are for informational purposes only unless expressly stated otherwise in writing.

  • Non-Binding Nature of Requests: The transmission of an email, text message, or website submission by the client does not automatically bind, alter, or cancel insurance coverage. Coverage is only considered bound once an authorized MOK INSURANCE agent issues an express confirmation (written or electronic) through authorized systems, and it is accepted by the company. All coverage is subject to underwriting approval and the formal issuance of policy documents, declarations, or binders.

  • No Guarantee of Coverage: Quote requests or policy change applications do not constitute confirmed coverage. All policies are subject to review, terms, and availability from the third-party insurance company.

  • Agency Role Disclosure: MOK INSURANCE acts as an independent insurance agency and is not the insurer. Insurance policies are issued by third-party companies; MOK INSURANCE does not guarantee risk acceptance or policy issuance.

  • Timing of Requests: Requests sent outside of normal business hours, on weekends, or on holidays, will be deemed received on the next business day. MOK INSURANCE is not responsible for technical failures or delays in electronic transmission that may prevent the timely receipt of your request.

Additional Disclosures and Electronic Communication Risks

  • No Professional Advice: Information provided by MOK INSURANCE, whether through the website, email communications, telephone conversations, or in person, is intended for general informational purposes only and shall not be construed as legal, financial, or professional advice. Clients are responsible for reviewing policy terms, conditions, exclusions, and coverage limits to determine whether a policy meets their specific needs.

  • Insurance Company Responsibility: Insurance policies are issued and underwritten by third-party insurance companies. Coverage determinations, underwriting decisions, premiums, cancellations, non-renewals, claims handling, and policy administration are solely the responsibility of the issuing insurance company. MOK INSURANCE does not control or guarantee the actions, decisions, or performance of any insurance company.

  • Electronic Communication Security: While MOK INSURANCE implements reasonable security measures, electronic communications may not be secure or error-free. MOK INSURANCE shall not be responsible for damages arising from unauthorized access, interception, fraud, or alterations of electronic communications transmitted via email or other digital channels. Clients are encouraged to verify payment instructions and sensitive requests directly with our office by telephone.
